TERMS AND CONDITIONS

1. Medical Disclaimer

Diamond Touch Health provides functional medicine, psychiatric, aesthetic, and wellness services in the State of New Jersey. Information presented on this website is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Viewing this website or submitting general inquiries does not establish a provider-patient relationship.

If you are experiencing a medical emergency, call 911 immediately.

2. No Guarantee of Results

Individual results vary based on medical history, compliance, genetics, and lifestyle factors. Diamond Touch Health does not guarantee specific outcomes from any service, treatment, consultation, or program.

3. Appointments, Payments & Cancellations

• Appointments must be scheduled through the designated booking platform (Optimantra or approved system). • Payment is due at the time of service unless otherwise arranged. • Insurance billing is subject to verification and coverage approval. • Certain aesthetic or wellness services may not be covered by insurance.

Cancellation Policy: At least 24 hours’ notice is required. Late cancellations or no-shows may result in a fee.

4. Electronic Communications

By submitting forms on this website, you consent to being contacted by Diamond Touch Health via phone, email, or SMS (if applicable). Standard messaging rates may apply.

Electronic communications may not be fully secure. Medical concerns should be communicated through the secure patient portal.

5. Telehealth Services (New Jersey Compliance)

Diamond Touch Health may provide telemedicine services in accordance with N.J.S.A. 45:1-61 et seq.

• Telehealth services are subject to the same standard of care as in-person visits. • Patient identity and location will be verified at the time of service. • Certain services may require in-person evaluation depending on clinical necessity. • Prescribing via telemedicine complies with New Jersey and federal regulations.

By scheduling telehealth services, you consent to receive care via secure electronic communication platforms.

6. Controlled Substances & Prescribing

Prescribing practices comply with: • New Jersey Prescription Monitoring Program (NJPMP) • Federal DEA regulations • Applicable state medical board standards

Certain medications may require in-person evaluation, laboratory work, or ongoing monitoring. Diamond Touch Health reserves the right to decline prescribing when clinically inappropriate.

7. Medical Records & Patient Rights (New Jersey)

In accordance with New Jersey law (N.J.A.C. 13:35 & 8:43G):

• Patients have the right to access and obtain copies of their medical records. • Reasonable fees may be charged for record reproduction as permitted under New Jersey regulations. • Records are retained for the period required by law (generally at least seven years for adults; longer for minors).

Requests for records must be submitted in writing.

8. Third-Party Platforms

Diamond Touch Health utilizes third-party platforms including but not limited to:

• Optimantra (EHR & Billing) • Wix (Website Platform) • Payment Processors • Social Media Platforms

Diamond Touch Health is not responsible for the privacy practices of third-party platforms.

9. Intellectual Property

All website content, branding, logos, text, graphics, and materials are the property of Diamond Touch Health and may not be copied or reproduced without written permission.

10. Limitation of Liability

Diamond Touch Health is not liable for: • Indirect or incidental damages • Website access interruptions • Misuse of website information • Unauthorized electronic access beyond reasonable safeguards

11. Modifications

Diamond Touch Health reserves the right to update or modify these Terms and Conditions at any time.

12. Binding Arbitration, Jury Waiver & Dispute Resolution

THIS SECTION CONSTITUTES A LEGALLY BINDING AGREEMENT. PLEASE READ CAREFULLY.

As a condition of receiving services from Diamond Touch Health, you agree that any dispute, claim, or controversy arising out of or relating to medical treatment, psychiatric services, aesthetic procedures, wellness therapies, billing matters, insurance claims, contractual relationships, or website use shall be resolved exclusively through final and binding arbitration.

Arbitration Procedures: • Arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Healthcare Payor Provider Arbitration Rules or Commercial Arbitration Rules, as applicable. • Arbitration shall occur in the State of New Jersey in the county where Diamond Touch Health primarily operates. • The arbitrator shall be a licensed attorney or retired judge with experience in healthcare or medical malpractice matters. • The arbitrator shall apply the substantive laws of the State of New Jersey. • The arbitrator’s award shall be final and binding and may be entered as judgment in any court of competent jurisdiction.

Waiver of Jury Trial: You knowingly, voluntarily, and expressly waive your constitutional right to a trial by jury for any dispute related to services rendered.

Class and Representative Action Waiver: All claims must be brought solely in your individual capacity. You waive any right to participate in a class action, collective action, consolidated action, or representative proceeding.

Pre-Arbitration Notice Requirement: Prior to initiating arbitration, the parties shall provide written notice of the dispute and allow thirty (30) days for good-faith resolution.

This arbitration provision survives termination of services and applies to all claims, including those sounding in negligence, malpractice, breach of contract, statutory violations, or other legal theory.

Nothing herein prevents a party from seeking temporary injunctive relief in a court of competent jurisdiction where necessary to preserve patient safety, confidential information, or intellectual property.

13. Financial Responsibility, Refund Policy & Chargeback Protection

Acknowledgment of Financial Responsibility: By scheduling or receiving services, you acknowledge full financial responsibility for all charges incurred, including services not covered by insurance. Insurance verification does not guarantee payment.

Medical & Psychiatric Services: Professional services rendered by licensed providers are non-refundable once delivered. Fees reflect the provider’s time, clinical judgment, and professional expertise.

Aesthetic, Injectable & Wellness Services: Due to the individualized and medical nature of aesthetic procedures, injectables, IV therapy, hormone treatments, and wellness services: • All payments are non-refundable once treatment has commenced. • Products that are opened, compounded, prepared, or administered are non-returnable. • Clinical outcomes cannot be guaranteed.

Service Packages: Prepaid packages represent bundled medical services at a reduced rate. Once any portion of a package is used, refunds are not available. At the sole discretion of Diamond Touch Health, unused portions may be converted to non-transferable account credit, unless otherwise prohibited by law.

Deposits: Procedure or consultation deposits secure provider time and are non-refundable. One courtesy transfer may be granted with at least 24 hours’ notice.

Chargeback & Payment Dispute Policy: You agree not to initiate a credit card chargeback or payment dispute without first providing written notice and allowing Diamond Touch Health an opportunity to resolve the concern.

Improper chargebacks for valid services rendered may constitute breach of contract. Diamond Touch Health reserves the right to: • Provide clinical and billing documentation to financial institutions to dispute chargebacks • Recover administrative costs, collection expenses, and legal fees as permitted by law • Suspend future services pending resolution

Nothing in this section limits rights granted under applicable New Jersey consumer protection statutes.

14. Informed Consent Acknowledgment

By receiving services from Diamond Touch Health, you acknowledge and agree that:

• You have the opportunity to ask questions regarding recommended treatments. • You understand the nature, purpose, potential benefits, and possible risks of proposed medical, psychiatric, or aesthetic services. • No guarantees or warranties have been made regarding clinical outcomes. • You understand that all medical procedures carry inherent risks, including but not limited to adverse reactions, complications, or unsatisfactory results. • You accept responsibility for following post-treatment instructions and provider recommendations.

Formal written informed consent documents will be provided separately prior to specific procedures as required by law.

13. Refund Policy & Chargeback Protection

Medical & Psychiatric Services: All medical and psychiatric services rendered are non-refundable once provided.

Aesthetic & Wellness Services: Due to the nature of aesthetic, injectable, IV therapy, and customized wellness treatments, payments are non-refundable once services are rendered or products are opened, prepared, or administered.

Package Purchases: Service packages are non-refundable once initiated. If a patient chooses to discontinue treatment, unused services may be converted to account credit at the sole discretion of Diamond Touch Health, unless otherwise prohibited by law.

Deposits: Deposits for consultations or procedures are non-refundable but may be transferred once with at least 24 hours’ notice.

Chargebacks & Payment Disputes: By providing payment information, you agree not to initiate a chargeback without first contacting Diamond Touch Health to resolve the matter. Initiating a chargeback for valid services rendered may constitute breach of contract.

Diamond Touch Health reserves the right to: • Provide documentation to financial institutions to contest improper chargebacks • Recover fees, administrative costs, and collection expenses associated with disputed payments • Suspend or terminate services for unresolved payment disputes

Nothing in this section limits rights provided under applicable New Jersey consumer protection laws.

NOTICE OF PRIVACY PRACTICES (HIPAA)

Psychiatric and mental health treatment records may be subject to heightened confidentiality protections. Certain disclosures may require additional written authorization.

Minor Consent

Under New Jersey law, minors may consent to certain services including specific mental health, substance use, or sexual health services under defined circumstances. Confidentiality protections apply as required by law.

HIV & Communicable Disease Records

Records related to HIV/AIDS and certain communicable diseases are protected under additional New Jersey confidentiality statutes and require specific authorization for disclosure.

6. Marketing & Authorizations

Diamond Touch Health will not use your PHI for marketing purposes without written authorization. Patient testimonials, before-and-after images, or identifiable materials require signed consent.

7. Breach Notification

In the event of a breach of unsecured PHI, Diamond Touch Health will notify affected individuals in accordance with federal and New Jersey law.
